Dear members,
Eastsound Water received a signed petition with the correct number of member signatures required to hold a special meeting to consider the recall of the following Directors as outlined in our bylaws:
- Ron Claus
- Carol Ann Anderson
- Jim Cook
The petitioner submitted the following statement:
These petitions signed by Members of EWUA request a special meeting of the Members to vote on the removal of the following three EWUA directors.
- Carol Ann Anderson
- Ron Claus
- Jim Cook
Two of our elected Directors and one of our appointed Directors have breached their fiduciary duties as board members of the Eastsound Water Users Association. During a regular board meeting in June, it was brought to the attention of the members that Carol Ann Anderson and Ron Claus filed affidavits to the San Juan Superior Court in support of the Farm to Market Lawsuit. A third director, Jim Cook, filed an affidavit with the San Juan Superior Court on July 26, 2024, disclosing copies of an attorney/client privileged letter from the members attorney, Rochelle Doyea. These affidavits are in direct opposition to the Association. None of these Board Members notified the other Board Members or received Board approval before they took action that was contrary to the best interests of EWUA.
We as members of the Association need to step up and recall these three Directors. They are not acting in the best interests of our Association. We are requesting they appear on the recall ballot separately and not as a group.
The Association’s attorney addressed these breaches with the SJC Superior Court last Tuesday:

In addition, we confirmed today that the first recall petition received by these same Directors and their friends on July 22, 2024 is also valid. This was announced via multiple places on the internet by these petitioners. That recall effort is to remove the following:
- Jim Nelson
- Teri Nigretto
- Mike Cleveland
- Leith Templin
- Any appointee made to the Board prior to or at any Member meeting.
Yes, in case you missed it, that means that all 7 of your EWUA Board of Directors will be brought up for removal by vote if the membership meeting meets quorum.
We will send out the bylaw required “Official Member Notice” with details on this Director Recall meeting in the next few weeks.
This is a serious step for both the members and the Directors up for removal. Please give us time to be diligent about ensuring a fair and accurate membership meeting.
